Thingsty Inc. doing business as Thingsty (hereinafter referred to as “Thingsty” and also as “we” and “us”) respects your privacy and understands the importance of protecting your Personal Information.
This Privacy Policy, in compliance with applicable laws, outlines the principles and practices that Thingsty follows in protecting your Personal Information. In this Privacy Policy, we will inform you of why and how we collect, use, and disclose your Personal Information. Our privacy commitment includes ensuring the accuracy, confidentiality, and security of your Personal Information and allowing you to request access to and correct your Personal Information.

Personal Information” means any information that, when used alone or combined with other information, may be used to identify an individual. This includes, but is not limited to, an individual’s first and last names, e-mail address, IP address, current location, mailing and/or residential addresses, telephone number, title, birth date, gender, occupation, contact information and/or other personal information that may be required in order for us to provide a service you request, or may have requested, on the Products.
Contact Information” means information that would enable an individual to be contacted at a place of business and includes name, title, business telephone number, business email, and business address. Contact Information may be considered Personal Information under the law.
Non-Personal Information” means information that alone cannot be used to identify or contact you. This may include information about your computer, integrated devices, platform, and click paths.
Privacy Officer” means the individual designated responsibility for ensuring that Thingsty complies with this Policy.
Products” mean Thingsty-owned products including websites, apps, software, servers, and devices.
Services” mean all the services offered by us to you while you use our Products.
Third Party Sources” mean third party companies, business or other entities which share information with or receive information from Thingsty or provide integration services or hardware products to Thingsty for optimal experience of the Products. These include device manufacturers and service providers on the Thingsty marketplace.
Website” means the website of Thingsty, namely www.thingsty.com.

What Personal Information Do We Collect?

We collect the following categories of Personal Information:

PRIVACY PRINCIPLES

The privacy principles in this Privacy Policy (the "Principles") are based, as far as possible, on the privacy and data protection laws of Delaware, United States of America.
NOTICE: Our Products collect information from your personal or business premises, including information on your devices, information collected from the Products or from your devices which shall be connected through the Products, information that you have disclosed voluntarily and other information provided to us by a Third Party Source. The purpose of all this information is to maximize your experience of our Products and the utility in our Services.
SECURITY: Thingsty, while maintaining, using or disseminating Personal Information, shall take reasonable precautions to protect it from loss, misuse and unauthorized access, disclosure, alteration and destruction.
DATA INTEGRITY: We shall collect and use Personal Information only in ways relevant for the purpose(s) for which it was collected or subsequently authorized to be used by you. We shall not process Personal Information in a way that is incompatible with the purposes for which it has been collected or subsequently authorized by you. To the extent necessary for those purposes, we shall take reasonable steps to ensure that data is reliable for its intended use, accurate, complete, and current. However, it is your responsibility to ensure that your Personal Information is accurate, complete and current and we will not be liable for any mistakes made by you in providing your Personal Information.
ACCESS: You will have access to your Personal Information that we hold and you will be able to correct, amend, or delete that information where it is inaccurate, except where the burden or expense of providing access would be disproportionate to the risks to your privacy in the case in question, or where the rights of third parties would be violated.
SHARING: Any information provided by you may need to be shared with Third Party Sources that are integrated with our Products to enhance your experience of our Services. For example, we may be sharing and receiving information from your IoT devices and providing analytical data on your dashboard using such information. If you wish that we do not exchange information with a Third Party Source, you may choose to remove such device from our list of integrated devices in the manner provided in the Tutorials. If you agree to receive any services from our Third Party Sources listed on our Products, you choose to share relevant information with them and we shall not be liable for any privacy obligations applicable to them. The Third Party Sources are independent companies and businesses and we cannot enforce any legal obligations on the same.

Why Does Thingsty collect Personal Information?

We collect your Personal Information because it helps us deliver a superior level of Services. It enables us to provide you with cutting-edge IoT services, and to process payments for Products and Services. In addition, your Personal Information helps us keep you posted on the latest product features, special offers, and events that you might like to hear about.
We process your Personal Information for legitimate business purposes, to meet our legal obligations, to fulfil contractual or pre-contractual obligations, or when you have given us your consent.
Legitimate business purposes include some or all of the following: where the processing enables us to enhance, modify, personalise or otherwise improve our Services and communications for the benefit of our customers; to identify and prevent fraud; to enhance the security of our network and information systems; to better understand how people interact with our Products; to provide communications which we think will be of interest to you; to determine the effectiveness of promotional campaigns and advertising. Whenever we process data for these purposes we will ensure that we always keep your privacy rights in high regard and take account of these rights. You have the right to object to this processing if you wish, and if you wish to do so please contact support@thingsty.com. Please bear in mind that if you object this may affect our ability to carry out some tasks for your benefit.

How Does Thingsty Collect Personal Information?

We collect Non-Personal and Personal Information when you use the Products. In addition, we use cookies and other technologies to passively collect some information. These methods are described more fully below.

Log Files
As is true of most Products, when you use the Products, we gather certain information automatically and store it in a log file. This information includes Internet Protocol (IP) address, top level domain name (for example .com, etc.), date and time of visit to the site, Internet Service Provider (ISP), type of browser used, web pages accessed, and documents downloaded. Due to Internet communications standards, when you visit our website we automatically receive the URL of the website from which you came and the website to which you go when you leave our website. The information we gather is used to help us administer our website, monitor traffic, improve the website’s accessibility and navigability, and gather aggregated preferences.

Collecting Your Information through Cookies
Cookies are small files applied to your internet browser to track your website movements. We may use cookies to deliver content specific to your interests and to monitor website usage. Cookies may be linked to a database that stores information regarding what pages you have viewed and links you have clicked. Standing alone, cookies do not personally identify you; they merely recognize your computer. Unless you choose to identify yourself to us, or have previously identified yourself to us, you remain anonymous.
You can control the use of cookies at the individual browser level or directly on our website, but if you choose to disable cookies, it may limit your use of certain features or functions of our website. To control cookies directly on our website, click on the “Privacy Settings” link in the footer of our webpage. However, for optimal use of the Products, we recommend that the cookies remain enabled.

How Does Thingsty Use Your Personal Information?

We may combine Personal and Non-Personal Information to better understand the behavior and preferences of our customers, to attribute sales to marketing activities, to troubleshoot technical problems, to enforce our Terms of Use and License Agreements, and to ensure the proper functioning of our products as well as to help improve them. In addition, the information you provide will allow us to send you messages about new products, features, enhancements, special offers, and events of interest. You may opt out of receiving marketing emails at any time.
We use a third-party credit-card payment processor and information related to credit card payments will be directly routed to that payment processor. These third-party companies are authorized to use your Personal Information only as necessary to provide the requested service to us.
We may use the geographic location of your IP address to customize the content you can see in certain regions so that it is more relevant to you.
We may aggregate information from multiple sources to create a more complete profile of your use and interactions with us and so that we can provide better support to you.
From time to time, we may partner with other companies to jointly co-host webinars, training seminars, or other events. If you specifically register for a jointly-offered event, then we may share your Personal Information, to the extent collected in connection with such event, with our co-host. Co-hosts’ use of the information will be in accordance with their own privacy policies. If you do not wish for your information to be shared in this manner, you may opt not to register in a jointly-offered event.
When we collect your Personal Information from you, we will inform you at the time as to the reason we are requesting such Personal Information. We use your Personal Information in any or all of the following ways:
  1. to register you as a user of the Products and/or Thingsty;
  2. to enable it to provide you Services as a user of the Products and/or Thingsty;
  3. to obtain your feedback on Thingsty;
  4. to provide you with informative communication, updates and news;
  5. to filter the content that you access for relevance;
  6. to be able to connect you with your customers, as the case may be, or with persons with similar interests;
  7. for statistical and research purposes, including market research;
  8. to respond to your requests for products, documentation and/or services;
  9. to process your order or invoice;
  10. to conduct a commercial transaction;
  11. to correspond with you and/or your company;
  12. to enable your subscription or event registration;
  13. to process a job application;
  14. to sending direct marketing information; and/or
  15. to personalize the content you review and to better understand how you use the Products in order to improve the Services provides as well as the Products information.
Upon your acceptance of the Terms of Use, of which this Privacy Policy is a part, such an acceptance will include your permission to us to collect and use your Personal Information. However, you have the right to request us not to contact you for the purposes of sending you newsletters, customer surveys, direct marketing materials and/or market research information. You can exercise this right by clicking on the appropriate option or checkbox at the point where the Personal Information is collected or by editing your Personal Information we have collected.

How Does Thingsty Get Your Consent?

We will obtain your consent to collect, use, or disclose Personal Information. Your consent may be express or implied where the purpose for collecting or disclosing the Personal Information would be considered obvious and you voluntarily provide Personal Information for that purpose (for example: submitting an email request for support or signing up for a webinar). We will seek your express consent for direct marketing purposes where necessary under those regulations or the regulations of other jurisdictions. Your use of the Products, the nature of which include collecting information, for example cameras, means consent to Thingsty of sharing your information.
Subject to certain exceptions, you may withhold or withdraw your consent for Thingsty to use your information by removing a particular device which collects information with the list of devices paired with Thingsty, deleting your accounts with us, or by contacting support@thingsty.com. Your decision to withhold or withdraw your consent to certain uses of Personal Information may restrict our ability to provide a particular service or product. If so, we will explain the situation to assist you in making the decision.
We may collect, use, or disclose Personal Information without your knowledge or consent only in the following limited circumstances:
  • When the collection, use, or disclosure is required by law;
  • When the information is necessary to investigate a breach of an agreement or a contravention of a federal or provincial law;
  • When the information is publicly available;
  • When it is clearly in the individual’s interests and consent is not available in a timely way; or
  • To comply with a subpoena, a warrant, or order made by a court or other body with appropriate jurisdiction.

Public Information Including User Generated Content & Profiles

You may choose to disclose information about yourself in the course of setting up a public profile or contributing user generated content to a public online forum provided by us. Information that you disclose in any of these forums is public information, and there is no expectation of confidentiality. You should be aware that any personally identifiable information you submit in the course of these public activities can be read, collected, or used by other users to send you unsolicited messages. We are not responsible for the personally identifiable information you choose to submit in these forums.

What Safeguards Does Thingsty Use to Protect Your Information?

We strive to limit the amount and type of personal information that we collect to just those details necessary to respond to your requests, share information with you, and process your transactions. We do not do regular or extensive profiling of individuals. Other than information required to process payments, we do not collect sensitive personal information. We will retain your information only as long as necessary to fulfil legal or reasonable business purposes.
We are committed to ensuring the security of your information in order to protect it from unauthorized access, collection, use, disclosure, copying, modification, or destruction. The following security measures will be followed to ensure that your information is appropriately protected: the use of user IDs and passwords, access restrictions, firewalls, antivirus programs, intrusion detection systems, system penetration testing, and physically secure office facilities.
We will use appropriate security measures when destroying your information such as shredding hardcopy documents and deleting electronically stored information.
We will continually review and update our security policies and controls as technology changes to ensure ongoing Personal Information security.

Children’s Privacy

The Products do not target, and are not intended to attract, users under the age of eighteen (18) years. We do not knowingly collect Personal Information from users under the age of eighteen (18) years or send requests to users under the age of eighteen (18) years for Personal Information. Where these Products are used by persons under eighteen (18) years, we strongly advise supervision by a parent or guardian and ensuring compliance with our policies and the law by parents/guardians while using Thingsty.

How Can You Access Your Personal Information?

You have the right to access your Personal Information. We will use reasonable efforts to ensure that your Personal Information is accurate and complete.

We will use reasonable efforts to reply to your request within thirty (30) days. We will inform you of the results of our investigation and let you know what actions have been taken by us in response to your request.

Disclosure of your Personal Information to Third Parties by Thingsty

If you elect to provide us with Personal Information, we may transfer that Personal Information within the Thingsty entities or to Thingsty affiliated third parties or business partners. Your Personal Information may be transferred within your country and/or across borders from your country of residence or jurisdiction to Thingsty entities, affiliated third parties and/or business partners in other countries around the world so that such Thingsty entities, affiliated third parties and/or business partners may provide services and other operations required to transact business with you. Such Personal Information may include, but is not limited to, account information and ordering/invoicing information.
Thingsty works with certain companies that deliver Thingsty advertising material and undertake surveys on behalf of Thingsty. These companies may collect information to help us determine which products, services and offerings are of most interest to our current and future customers. Unless you have given your explicit consent, the information collected is not identifiable at an individual level. However, it may be identifiable at a company level, with or without your consent, or aggregated at an anonymous level to provide us with general statistics and trends. If you have given your explicit consent for your Personal Information to be identifiable at an individual level, and you have any questions and concerns regarding the same, including queries regarding the companies receiving the Personal Information, you may send your questions at the Products or e-mail us at the e-mail address provided below and we would be happy to deliver relevant information.
In the event that Thingsty sells a part or parts of its business, the Personal Information that we have collected could be transferred to the acquiring company unless you instruct us not to do so in writing. We will publish a notice on the Products prior to such transfer.

Thingsty's policy towards your privacy and data protection

Except where your information is meant for access by other users of Thingsty, we will not disclose your Personal Information to any third party except in the course of performance of its services. Furthermore, we shall use its best efforts to ensure that your data is protected from unauthorized use.
We maintain reasonable infrastructure, techniques and methods for protecting the secrecy of your Personal Information, and for backing up your data in order to secure it against loss. However, it is your responsibility to ensure that you keep your User ID and Password secret and confidential at all times to prevent any third party from misusing your account. In the event of your User ID or Password coming into knowledge of any other person, you shall indemnify Thingsty, its directors, employees, partners, associates and clients, including Thingsty users, for any costs, claims, consequences and losses arising out of the misuse of your account.
We will conduct compliance audits of its relevant privacy practices to verify adherence to this Privacy Policy. Any employee that we determine is in violation of this Privacy Policy will be subject to disciplinary action, which may include termination of employment.
Collecting Your Domain Information
We also collect domain information as a part of our analysis of the use of the Products. This data enables us to become more familiar with the individuals who visit the Products, how often they visit, and what parts of the Products they visit most often. We use this information to improve our web-based offerings. This information is collected automatically and requires no action on your part.

Compliance with Laws

We strive to comply with all applicable and known laws around the world that are designed to protect your right to privacy and prevent misuse of your Personal Information. Although legal requirements may vary from country to country, we intend to adhere to the principles set forth in this Privacy Policy even if we transfer your Personal Information from your country of residence to countries that may not provide the same privacy rights or require the same level of protection for your Personal Information. Our commitment is to protect your Personal Information no matter where it is collected, transported, processed or retained.

No Liability

Notwithstanding anything to the contrary contained in this Privacy Policy, neither we, nor our owners, partners, shareholders, directors, management, executives, employees, or other representatives, nor any of our holdings, affiliates, subsidiaries, or associated businesses, shall be liable or responsible for any direct, indirect, special, incidental, punitive and/or consequential damages or losses arising from the leakage or theft of your Personal Information.

Exceptions

Notwithstanding our commitments to protect your privacy, we may divulge your Personal Information for any of the following reasons:
  1. defence and national or public security;
  2. the prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties, including the safeguarding against and the prevention of threats to public security;
  3. the protection of judicial independence and judicial proceedings;
  4. the prevention, investigation, detection and prosecution of breaches of ethics for regulated professions;
  5. the protection of the data subject or the rights and freedoms of others;
  6. the enforcement of civil law claims;
  7. to comply with a court or administrative order, direction or subpoena;
  8. to comply with any provision of the law;
  9. to enable its personnel, staff, employees or partners to provide you with services and improve your experience;
  10. in cases, where despite reasonable efforts by us to protect your Personal Information, the Personal Information can no longer be kept confidential;
  11. where we obtain or are able to obtain the Persona Information from a source independent from yourself; and
  12. where the Personal Information becomes part of the public domain.
